The Karnataka High Court recently declared that playing rummy is not considered gambling, whether with or without wagering. Judge SR Krishna Kumar's Court stated that games of chance played with stakes constitute gambling, while games of skill, with or without stakes, do not fall under the category of gambling. The court emphasized that rummy is predominantly a game of skill rather than chance.

The court also clarified that there is no distinction between physical/offline rummy and online/electronic/digital rummy, and neither form constitutes gambling, regardless of the presence of wagering.

The court addressed a series of writ petitions filed by online gaming platform Gameskraft and its founder, chief financial officer, and chief executive officer.

The company is challenging the Justification Notice issued by the General Department of Goods and Services Tax in September 2022, despite the High Court previously halting a previous tax notice amounting to Rs 21 crore issued to the company.

कर्नाटक उच्च न्यायालय ने हाल ही में घोषणा की कि रम्मी खेलना जुआ के रूप में मान्य नहीं है, चाहे दांव के साथ हो या बिना। न्यायाधीश एसआर कृष्ण कुमार की अदालत ने कहा कि दांव के साथ खेले जाने वाले मौके के खेल जुआ माने जाते हैं, जबकि कौशल के खेल, दांव के साथ या बिना, जुआ की परिभाषा में नहीं आते हैं। अदालत ने जोर दिया कि रम्मी मुख्य रूप से मौके के बजाय कौशल का खेल है।

अदालत ने स्पष्ट किया कि भौतिक/ऑफ़लाइन रम्मी और ऑनलाइन/इलेक्ट्रॉनिक/डिजिटल रम्मी के बीच कोई भेद नहीं है, और न तो किसी भी तरह का दांव होने पर न ही बिना दांव के जुआ माना जाता है।

अदालत ने ऑनलाइन गेमिंग प्लेटफॉर्म गेम्सक्राफ्ट और इसके संस्थापक, मुख्य वित्तीय अधिकारी और मुख्य कार्यकारी अधिकारी द्वारा दायर किए गए एक सिरीज रिट याचिकाओं का सम्बोधन किया।
